Welcome to VibeHackers! These Terms of Service ("Terms") govern your use of vibehackers.io (the "Service"). By using our Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using VibeHackers, you agree to be bound by these Terms. If you don't agree, please don't use our Service.

2. Description of Service

VibeHackers is a platform for indie builders to showcase projects and build in public. The Service includes:

• Project gallery and submission
• Build in Public tracking via GitHub integration
• Community features (comments, follows, upvotes)
• Vibe Board (collaborative canvas)

3. User Accounts

3.1 Account Creation

• You must be at least 13 years old to use VibeHackers
• You can authenticate via GitHub OAuth or by creating an account with your email and password
• You're responsible for your account security
• One account per person

3.2 Account Termination

• You can delete your account anytime in Settings
• We may suspend or terminate accounts that violate these Terms
• We reserve the right to refuse service to anyone

4. User Content

4.1 Your Content

• You retain ownership of content you submit (projects, descriptions, comments)
• You grant us a worldwide, non-exclusive license to display, distribute, and promote your content on VibeHackers
• You're responsible for your content and must have rights to share it

4.2 Content Guidelines You agree NOT to post content that:

• Violates laws or regulations
• Infringes intellectual property rights
• Contains malware or harmful code
• Is spam, harassment, or hate speech
• Impersonates others
• Contains explicit adult content

4.3 Content Moderation

• We reserve the right to remove content that violates these Terms
• We may feature or curate projects at our discretion
• Curated projects are marked with a "CURATED" badge

5. GitHub Integration

5.1 Repository Access

• When you enable Build in Public, you grant us read-only access to your GitHub repository
• We access: commit history, commit messages, and repository metadata
• We use this data ONLY to: track project progress and generate update summaries
• We do NOT: access code, clone repositories, or share your private data

5.2 Data Usage

• Commit messages may be summarized using AI (OpenAI API)
• Summaries are displayed publicly on your project updates
• You can disconnect GitHub access anytime in project settings

6. Vibe Board

6.1 Service Description

• Vibe Board is a collaborative canvas where users submit prompts to modify a shared webpage
• Each modification requires payment

6.2 Pricing

• Price starts at $0.10 per edit
• Price increases by $0.10 with each subsequent edit by any user
• Current price is displayed before payment
• Prices are in USD and non-negotiable

6.3 Payment

• Payments processed via Stripe
• All sales are final unless refund criteria met (see section 7)
• You must have authorization to use the payment method

6.4 Edits

• Your edit will be applied by AI (Anthropic Claude)
• Results may vary and are not guaranteed
• Edit history is public and permanent
• Inappropriate edits will be removed (no refund)

7. Refunds

7.1 Automatic Refund Eligibility

Refunds are processed automatically if:

• A technical error prevents your edit from being applied
• The AI subsystem decides to make no changes due to task ambiguity, if you explicitly request no changes, or if the changes you requested are not possible

7.2 Manual Refunds

Manual refunds may be processed if you request them by emailing [email protected] in the following cases:

• Your edit was removed by moderators for violating our guidelines
• You were charged incorrectly due to a system error

7.3 No Refund Situations

• Change of mind after edit is applied
• Dissatisfaction with AI-generated result

8. Intellectual Property

8.1 Our Property

• VibeHackers name, logo, design, and code are our property
• You may not copy, reproduce, or create derivative works

8.2 Third-Party Content

• Some projects are curated from public sources
• We respect intellectual property rights
• If your project was added without permission, contact us to claim or remove it

9. Privacy

Your privacy is important. See our Privacy Policy for details on how we collect and use data.

10. Disclaimers

10.1 "As Is" Service

• VibeHackers is provided "as is" without warranties
• We don't guarantee uptime, accuracy, or results
• Use at your own risk

10.2 No Liability

• We're not liable for damages from using (or inability to use) the Service
• We're not responsible for user-generated content
• We're not liable for third-party services (GitHub, Stripe, OpenAI, etc.)

10.3 AI-Generated Content

• AI summaries and Vibe Board edits are automated
• Results may be inaccurate or unexpected
• We're not responsible for AI output

11. Changes to Terms

• We may update these Terms at any time
• Changes effective immediately upon posting
• Continued use means acceptance of new Terms
• Material changes will be announced on the Service

12. Termination

We may terminate or suspend your access immediately, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service or other users
• Any other reason at our discretion

13. Governing Law

These Terms are governed by the laws of Spain (where the Service is operated), without regard to conflict of law principles.
